Failure to comply with the requirements expected of an affidavit of merit, particularly when a minor is involved in the legal procedure, is grounds to be deemed a failure to state a cause of action--requiring dismissal.
As a result of this iconic decision, which took place on December 14th, the Courts will now take additional administrative steps in order to greatly assist all attorneys across the state of New Jersey. The judgment of the Appellate Division was thus reversed, as the matter is now remanded to the trial court for further proceedings.
